The following is Vimsoft's Terms of Service agreement. By requesting any Vimsoft service you acknowledge that you have read, understood, and agreed to abide by all the terms set forth herein.
1. Acceptable Content
Vimsoft will only administer services for acceptable content. Unacceptable content is any material that is, or perceived to be, pornographic, obscene, hateful, pirated, unauthorized, gambling, or unlawful in nature. Vimsoft reserves the right to deny services for any content that possesses any of these characteristics, or any other characteristics that Vimsoft deems to be inappropriate. Vimsoft reserves the right to make the final decision on whether or not the material is acceptable. If you order an unacceptable service request prior to completing payment, Vimsoft will inform you that we will not administer our services and will cancel your order before processing your payment. If you have already completed payment for an acceptable service and later submit an unacceptable request (such as for website maintenance) we will inform you that the request cannot be completed but will not issue any refunds for prior purchases. If you have any questions about whether Vimsoft will find your content acceptable we recommend that you contact us and we will be happy to let you know in advance.
2. Responsibility for Content
Even if your content is deemed acceptable to publish, it is impossible for Vimsoft to confirm the authenticity, ownership, or predict potential conflicts that may arise from all content you submit. Therefore any content that you submit to Vimsoft is your responsibility. You agree that you will take responsibility for any disputes that arise over any content you submit to Vimsoft. Vimsoft will inform you of any issues over content that we become made aware of. If any such dispute is not resolved in a timely matter, or seems to be of a serious or urgent nature, Vimsoft reserves the right to remove or modify any or all content in dispute.
3. Web Browser Support
Vimsoft supports the latest release version of Internet Explorer, Firefox, and Safari, the most popular web browsers today. This means that we will quality test your Vimsoft website in each of these browsers during development and after each maintenance request you submit. We will quality test for working functionality as well as proper appearance. As part of our regular support we do not support or guarantee your Vimsoft website to work in any other type or version of web browser, other than the ones indicated. If you require support for other browsers we can meet that need for an additional service fee.
4. Website Limitation of Liability
Even though we do extensive quality testing on your website, we do not guarantee, after development or after completing a maintenance request, that every website element works flawlessly or meets your exact expectations. While this is certainly our goal, the complexity of today's web technology means unforeseen issues can arise despite extensive testing. If this should happen, simply contact Vimsoft, and we will work diligently to resolve it as soon as possible. This type of non-discretionary maintenance will not count toward your website maintenance plan. You agree that you will not hold Vimsoft liable for any financial or other losses incurred by any issue, problem, or other complication with your website. It is your responsibility to review and ensure that your website's functionality, performance, and appearance are satisfactory for your needs.
5. Ad Savings Limitation of Liability
If you elect to enroll in Vimsoft's Ad Savings feature, you agree that you will not hold Vimsoft liable for any advertising content displayed on your website. While we try our best to ensure that only appropriate and acceptable advertisements are displayed, we cannot guarantee that you personally will approve of advertising content before it displays. If you find any advertisements inappropriate we will do our best to resolve the situation. You agree that you will contact Vimsoft directly if you have concerns about any such advertisements, and NOT our advertisers.
6. Cancellations and Refunds
You may cancel any Vimsoft service at any time. It may take up to one week to deactivate your website or other services. Refunds will only be issued for completely unused months of service. We do not issue partial month refunds for our website, maintenance, and web advertising services. In the case of our website service, the first 6 months of your term is considered a start-up fee and is nonrefundable. For our graphic design service, no refunds are permitted once the design is approved or once you take receipt of any graphic files. All approved refunds will be issued through PayPal.
7. FAQs Review
You must review our Frequently Asked Questions (FAQs) section before purchasing any Vimsoft service. The FAQs answer some common questions about Vimsoft and the services we offer. It provides useful information that may help you determine whether or not Vimsoft services are appropriate for your needs.
8. Indemnification
You agree to indemnify and hold harmless Vimsoft and its employees and affiliates from all claims, liabilities, and expenses, including attorneys' fees and legal fees arising out of your use of any Vimsoft service or your breach of anything in this Terms of Service agreement.
9. Agreement Modification
Vimsoft reserves the right to modify any part of this Terms of Service agreement at any time without prior consent or notice. Vimsoft will attempt to contact current clients if any modification to this agreement will affect any already purchased services.
